## Significant changes are coming

As you may have heard, the real estate industry is undergoing a shift in how commissions get paid in real estate transactions. This is expected to start in July 2024. Here's what we know, pending court approval:

## What this means for YOU as a buyer

<sub>\*Martha’s Vineyard buyers pay a 2% [Land Bank](https://www.mvlandbank.com/transactions/frequently-asked-questions) fee on all transactions, except first time home buyers, which have a portion of the fee exempt if you own your home for 5 years.</sub>

With the upcoming changes, **entering into a real estate transaction necessitates an agreement** with your buyer's agent, and you may be liable for paying a real estate commission of 2-3% of the total sale.

The buyer's agency agreement will specify that the buyer's agent's compensation is to be negotiated at the time an offer is made.

However, if the seller refuses to compensate the buyer's agent, then you, as the buyer, might be liable for the agreed commission rate.

## How to prepare

Anchor Realty of Martha's Vineyard suggests that all potential and future buyers ACT NOW!

Listings that are on the market right now already have a buyer's agency commission built into the listing agreement. If you enter into a real estate agreement before the changes, go into effect you will be covered. After that you may be liable for the cost of having a buyer’s agent represent you.

## The importance of having a buyer's agent

Anchor Realty of Martha's Vineyard feels the role of a buyer's agent is extremely important, and we worry that Buyers will end up not being represented in the real estate transaction process. If you are buying a home through a Real Estate listing agent, then that Agent is working for the SELLER ONLY. Not you the Buyer.

## Island Towns

Now that we narrowed down what part of the Island you want to be in let’s take it town by town:

- [**Oak Bluffs**](/blog/oak-bluffs) is the number one vacation spot on Martha’s Vineyard. This is for many reasons. The town center and beaches are all in one area. In most cases it’s a small stroll or bike ride to both. There are large Victorian Homes around the town center of Oak Bluffs and the streets leading out of town to the beach. The Martha’s Vineyard Camp Meeting Association with it’s over 300 brightly colored gingerbread cottages is another popular destination.
- [**Edgartown**](/blog/edgartown) closely follows Oak Bluffs in popularity. The town center is filled with Large Whaling Captains houses with rose covered white picket fences. The famous South Beach and Katama area have wonderful beach homes for rent.
- [**Vineyard Haven**](/blog/vineyard-haven) has a lively town main street with Owen Park and beach for a quick dip. Tashmoo and West Chop are some of the Islands nicest beaches. Centrally located and with the steamship authority’s main terminal, easy accessibility to all towns.
- [**West Tisbury**](/blog/up-island-west-tisbury): You’re starting to get into the woods of the Vineyard, Larger tracts of land and wonderful beaches like Lambert’s Cove and Long Point. Large Farms and Horse ranches are on this fertile land.
- **Chilmark**: You’ll notice the vast green pastures and stone walls of Allen’s Sheep Farm and other estates that expand out to the Ocean’s Edge. This is truly a beautiful place. One of the Island most famous beaches Lucy Vincent is at your disposal when you rent here!
- **Aquinnah**: You have entered paradise. If you are lucky enough to find a rental in the special town go for it! Located at the very end of the Island there is a small center with Restaurants and shops. - **We are finding that many homes now have smart TVs**, which allow you to access your streaming channels. Please be sure to bring your account information with you so that you may enjoy them while on vacation.
- **All of our rental homes include free WIFI.**
- **Many island homes do not include linens.** This generally refers to sheets and towels.

Most homes will include pillows, blankets and mattress cover. You are certainly welcome to bring your own linens but linen rentals are available on the island and they will deliver the linens in advance of your arrival and retrieve when you depart. ## Transportation

If you are traveling without a car, it is important to check to see if beach chairs are included with the rental. There are companies on the island that will rent beach gear from chairs to umbrellas and beach toys.

## Aquinnah

Aquinnah the smallest of the Island towns is located on the island of Martha's Vineyard in Massachusetts. Until 1997, the town was called Gay Head. The population was 311 at the 2010 U.S. census. It is known for its beautiful clay cliffs and quiet natural serenity. In 1965, Gay Head Cliffs were designated as a National Natural Landmark by the National Park Service.

Aquinnah has become celebrated as a center of Wampanoag culture and a center of pride and tradition among members of the federally recognized Wampanoag Tribe of Gay Head. They make up about one-third of the town's voters and are one of two federally recognized tribes of Wampanoag people in Massachusetts. This area is one of the earliest sites of whaling. The Wampanoag harvested whales from small boats and the shore, using harpoons, long before the 19th-century industry of whaling became the major maritime industry of Martha's Vineyard.

In February 2019, [the Wampanoag Tribe of Gay Head](https://en.wikipedia.org/wiki/Wampanoag_Tribe_of_Gay_Head) announced it will begin construction of the Aquinnah Cliffs Casino in March 2019. [The tribe](https://en.wikipedia.org/wiki/List_of_federally_recognized_tribes) is scheduled to proceed with construction despite opposition from the towns of Aquinnah and [Chilmark](https://en.wikipedia.org/wiki/Chilmark,_Massachusetts), and a request from the Martha's Vineyard Commission for the Wampanoag tribe to work with the commission to "preserve the unique values of the Vineyard." The Wampanoag tribe says the commission has no [jurisdiction](https://en.wikipedia.org/wiki/Jurisdiction) over the project.

In 1796, Massachusetts State Senator, Peleg Coffin, requested a lighthouse be installed on Martha's Vineyard above the Gay Head cliffs overlooking a dangerous section of underwater rocks known as "Devil's Bridge."

The Gay Head Lighthouse Committee worked in conjunction with the town of Aquinnah and the [Martha's Vineyard island community](https://en.wikipedia.org/wiki/Martha%27s_Vineyard) to raise approximately $3.5 million to relocate the lighthouse about 129 feet (39 m) from its former location. The lighthouse was relocated by Expert House Movers and the General Contractor, International Chimney.



## Edgartown

The streets are line with Captains homes, with whalers’ walks’ and white picket fences and rose gardens. The Edgartown Light house perches out over Chappaquiddick with a little sandy beach.

Edgartown is the county seat and was once a major whaling port, with historic houses that have been carefully preserved. Today it hosts yachting events.

Martha's Vineyard's first colonial settlement and it has been the county seat since 1642. The stately white Greek Revival houses built by the whaling captains have been carefully maintained.
Edgartown was used as the main shooting location for the town of Amity in Steven Spielberg's 1975 blockbuster [Jaws](<https://en.wikipedia.org/wiki/Jaws_(film)>). Many landmarks and buildings in Edgartown that were filmed in the movie can still be seen today.

The [Edgartown Harbor Light](https://en.wikipedia.org/wiki/Edgartown_Harbor_Light) at the end of north Water Street defines the entrance to the Harbor. The harbor is large and entered through a modest sized channel on the North side of Edgartown. It opens into Katama Bay, created by a barrier beach that sometimes connects the south end of Chappaquiddick to the remainder of Edgartown, The barrier beach opened during a spring storm in 2007. This has led to a 3 knot current through Katama Bay and Edgartown Harbor. This protected body of water provides ample mooring for small and large boats. The opening of the harbor will accommodate large sailing and motorized boats, but will not accommodate large ships or yachts which may anchor outside the harbor.

Another feature is South Beach, a small part of the ocean beach that runs the entire southern length of the island from Edgartown to Aquinnah. It can be reached by driving or riding the bus south from Edgartown center for approximately 2.5 miles. South Beach is a crashing ocean beach. It is a major destination for tourists. Much of the beach in Edgartown is open to the public with ample parking available. The section of the beach near Katama is often crowded, while the sections further to the west (near Edgartown Great Pond and Oyster Pond) are often less so.

The town of Edgartown includes the smaller island of [Chappaquiddick](https://en.wikipedia.org/wiki/Chappaquiddick_Island), sometimes connected to the rest of Martha's Vineyard only by a barrier beach which can be breached during storms. Chappaquiddick is separated from the town center by Edgartown Harbor and Katama Bay. The town is close to Nantucket's [Muskeget Island](https://en.wikipedia.org/wiki/Muskeget_Island), which is seven miles east of Wasque Point, the southeasternmost point of Chappaquiddick.
Katama is the south-central portion of Edgartown. In addition to a beach, Katama has within its boundaries the Katama Airpark, the Katama Farm, the Herring Creek Farm and two resorts. Edgartown is also home to half of the Manuel F. Correllus State Forest, which extends into neighboring West Tisbury. There are nine beaches, a yacht club, and several preserves and reservations in the town, including the Wasque Reservation along the south shore of Chappaquiddick and the Cape Pogue Wildlife Refuge along the east shore of the island. There are two lighthouses in the town, the Cape Pogue Light on Chappaquiddick and the Edgartown Harbor Light in Edgartown Harbor.

The town includes the island of [Noman's Land](<https://en.wikipedia.org/wiki/Nomans_Land_(Massachusetts)>), which lies southwest of Martha's Vineyard. Because of Noman's Land, the town is officially the second most southerly point in Massachusetts (the south shore of [Nantucket](https://en.wikipedia.org/wiki/Nantucket,_Massachusetts) is approximately a kilometer south of the southernmost point on Noman's Land).

Chilmark has a series of small ponds along the Atlantic side of the town, and it shares Tisbury Great Pond to the east and [Menemsha Pond](https://en.wikipedia.org/wiki/Menemsha_Pond) and Squibnocket Pond to the southwest, along the Aquinnah town line. It is between these two ponds, which are 1,100 feet (340 m) apart at their closest point, that the only road to Aquinnah passes.

Long Beach, privately owned, runs along the southern side of Squibnocket Pond and technically connects the towns. At one point in the late 17th and early 18th century, Squibnocket Pond was open to the sea. However, the [barrier beach](https://en.wikipedia.org/wiki/Barrier_beach) with its sand dunes eventually closed this opening permanently. Occasionally in winter storms, waves will wash across low points in the beach, but the beach itself has not been breached in a hundred years, unlike other barrier beaches on Martha's Vineyard.



## Martha's Vineyard

MARTHA'S VINEYARD is an island off the southwestern coast of Cape Cod, Massachusetts, in the Atlantic Ocean.

## Oak Bluffs

The town of Oak Bluffs, nestled on the Island of Martha’s Vineyard, is one of the most famous seaside Victorian towns in New England the United States at large. Once known as Cottage City.

The Polar Bears, a community group of predominantly African American women who hold early morning prayer and swimming sessions, can be found at this beach in the early morning hours from the beginning of summer through Columbus.
- **Joseph Sylvia State Beach** - In Oak Bluffs the Joseph Silva State Beach extends down the Beach Road toward Edgartown. Parking and access are easy here as well as at the Oak Bluffs Town Beach, which starts at the OB Steamship dock and extends out well beyond Ocean Park.
- **African American Heritage Trail** – The trail celebrates the stories of African American people on the Island. There are bronze markers on the 30 selected sites that tell the story.
- **Oak Bluffs Harbor** - A landlocked basin protected by two breakwaters. Oak Bluffs Harbor is a popular destination for pleasure boats.
- **The Oak Bluffs Marina** is the largest marina on Martha's Vineyard, with 81 slips and 50 moorings, fuel and pump-out facilities

## Up-Island

Much of what makes the Vineyard special is found in its rural reaches in the agricultural heart of the island and the largely undeveloped lands south and west of the Vineyard Haven- Edgartown line; known as “UP-ISLAND”. Country roads meander through woods and tranquil farmland, and dirt roads, abandoned cranberry bogs, and conservation lands. In Chilmark, West Tisbury, and Aquinnah, nature lovers, writers, artists, and others have established close, ongoing summer communities. In winter, the isolation and bitter winds generally send even year-round Vineyarders from their Up-Island homes to places in the cozier Down-Island Towns.

## West Tisbury

_6½ miles southwest of Vineyard Haven, 12 miles northeast of Aquinnah._

Founded in the 1670’s by settlers from Edgartown, among them the son of Myles Standish and the son-in-law of the Mayflower Alden’s, West Tisbury was know for its first 200 Westernized years simply as Tisbury. Most important among the settlement’s advantages over Down-Island outposts was a strong-flowing stream that ran into a pond, crating a perfect mill site- a rarity on the Vineyard. Farming, especially sheep farming, became Tisbury’s mainstay.

West Tisbury retains its rural appeal and maintains its agricultural tradition at several active hors and produce farms. The town center looks very much the small New England village, complete with a white, steeple church. Half the 5,146 acre Manuel F. Correllus State Forest lies with the town limits.

## Beaches

1. **Lambert’s Cove Beach**. (Lambert’s Cove Rd) one of the island’s prettiest, has fine sand and clear water. The Vineyard Sound-side beach has calm waters good for children and views of the Elizabeth Islands. In season it is restricted to residents and those staying in West Tisbury. Rest rooms are available.
2. **Long Point**, a Trustees of Reservation preserve, has a beautiful beach on the Atlantic, as well as freshwater and saltwater ponds for swimming, including the brackish Tisbury Great Pond. Rest rooms are available.
3. **Uncle Seth’s Pond (Lambert’s Cove Rd)** is a warm freshwater pond on Lambert’s Cove Road, with a small beach right off the road. Seth’s is very popular with families. Parking is very limited.

### Cedar Tree Neck Wildlife Sanctuary

Indian Hill Rd. Off of State Rd. for 2 mi, and then turn right 1 mi onto Obed Daggett Rd., and occasionally steep, rocky, dirt road to the parking lot, free.

### Mayhew Chapel and Indian Burial Ground

Off Indian Hill Rd., off State Rd are suffused with history.

The tiny chapel built in 1829 to replace and earlier one, and a memorial plaque are dedicated to the pastor Thomas Mayhew, Jr. leader of the original colonists who landed at Edgartown in 1642. Mayhew was noted for his fair dealings with the local Wampanoags. Within a few years, he had converted a number of them to Christianity. Called Praying Indians, they established a community here called Christiantown.

An overgrown wildflower garden grows near the chapel. Beyond the boulder with the plaque are the rough-hew stones marking Native American grave mounds-the dead are not named, for fear of calling down evil spirits. Behind the chapel is the beginning of the Christiantown Woods loop trail, which leads to lookout tower. You’ll find a map at the head of the trail.

### Sepiessa Point Reservation

Off Tiah’s Cove Rd.

A 164-acre area of the Land Bank Commission. A long walk along Tiah’s Cove leads to the beach, at the southerly point, alongside Tisbury Great Pond. Across the pond you can see the ocean. The very narrow beach is perfect for those with canoes or kayaks. You can put your boats in at the trailhead and paddle across the pond to the barrier beach for picnicking and swimming. There’s parking only for a few cars at the trailhead.

### Manuel F. Correllus State Forest

At the center of the island, is a 5,000 acre pine and scrub-oak forest crisscrossed with hiking trails and circled by a pave but rough bike trail. There’s a 2-mi nature trail, a 2 mi par fitness course, and horse trails. The West Tisbury side of the state forest joins with an equally large Edgartown parcel to virtually surround the airport.

## Attractions

**<ins>Farmer's Market</ins>**

The weekly **West Tisbury Farmers’ Market**-Massachusetts largest- is held Wednesday and Saturdays in the summers at the 1859 Old Agricultural Hall (South Rd.), near the town hall. The colorful stands overflow with fresh produce, most of it organic.
Built in 1996, the New Ag Hall (35 Panhandle Rd.) about a mile from the Old Agricultural Hall, is the setting for various shows, lectures, dances, weddings, and potluck dinners. A yearly country fair- including a woodsman contest, dog show, oyster/clam shucking contest, games, and of course, livestock-and produce-judging-is held here in mid to late August.

**<ins>Polly Hill Arboretum</ins>**

A rich and expansive collection of flora and serene walking trails are the attractions of the **Polly Hill Arboretum**. The late Polly Hill was a horticulturist and tended some 2,000 species of plants and developed nearly a 100 species herself on her old sheep farm in West Tisbury. On site are azaleas, tree peonies, dogwoods, hollies, lilacs, magnolias, and more. Hill raised them from seeds without the use of a greenhouse, and her patience is the inspiration to the arboretum. Now run as a nonprofit center, the arboretum also runs guided tours, a lecture series, and a visitor center and gift shop. (809 State Rd. 508-693-9426, Late May-Mid Oct.)

The late Tom Maley’s white sculptures, such as the colonial horse and rider or a whimsical piper are displayed on a wide lawn. Inside there are changing summer exhibitions of island artist’s work, which is for sale.

Step back in time with a visit to Alley’s General Store (State Rd.), the heart of the town since 1858. Alley’s sells a truly general varies of goods: everything from hammers, house wares, kid’s toys, gifts, cards, candy, milk, ice cream, coffee, muffins, fresh produce, even a post office inside.

## Vineyard Haven

**Vineyard Haven**, the beautiful working harbor village in the town of Tisbury is not only the year-round port for Martha’s Vineyard, it also has a really fun and diverse Cultural District.

Love maritime history? Check out the whaling and industry captains’ homes on Williams Street, and the beautiful murals on the walls of the second-floor gallery in the Katherine Cornell Theater. Lake Tashmoo has public boat launch, and is wonderful for boating, fishing and clamming. In the winter there is scalloping in the Lagoon.
